Moreno Valley Probate Attorney Discusses Trusts

Good evening, Moreno Valley and welcome back to our segment on estate planning. I’m your host, Brenda Sanchez, and tonight we have the pleasure of speaking with Steve Bliss, a renowned probate attorney here in Moreno Valley. Steve, thanks for joining us.

Different Types of Trusts

Steve, many people are unfamiliar with trusts and how they can benefit their estate planning. Could you shed some light on different types of trusts?

There are numerous types of trusts, each serving a specific purpose. One common type is the Irrevocable Trust.

Understanding Irrevocable Trusts

Steve, could you elaborate on Irrevocable Trusts and their benefits?

An Irrevocable Trust, as its name suggests, cannot be altered or dissolved once it’s created. Consequently, this offers significant advantages for asset protection and estate tax planning. Assets placed within an Irrevocable Trust are removed from the grantor’s taxable estate, reducing potential estate taxes. Moreover, creditors generally cannot access assets held within such a trust, safeguarding them from lawsuits or financial liabilities. Nevertheless, it’s crucial to remember that transferring assets into an Irrevocable Trust is a permanent decision.

The ability to shield assets from creditors and minimize estate taxes makes Irrevocable Trusts a powerful tool for wealth preservation. Accordingly, they are often utilized by individuals with substantial assets or those seeking to protect their legacy for future generations.

I had a client once who was facing a significant lawsuit. He had wisely established an Irrevocable Trust years earlier. When the lawsuit arose, his assets within the trust were protected, saving him from potential financial ruin. It’s a testament to the power of foresight and proper planning.

Challenges with Irrevocable Trusts

Steve, are there any challenges or drawbacks associated with Irrevocable Trusts?

While Irrevocable Trusts offer significant benefits, they also require careful consideration. The primary drawback is their irrevocable nature. Once assets are transferred, the grantor relinquishes control over them. Conversely, a Revocable Living Trust allows for greater flexibility during the grantor’s lifetime.

It’s important to remember that Irrevocable Trusts should be tailored to individual circumstances and goals. Ordinarily, I recommend seeking professional legal advice to determine if an Irrevocable Trust is the right fit for your needs.
