Understanding the Importance of “Marshaling Estate Assets”

Steve, could you walk our viewers through one of the key steps in the probate process?

Steve:

Certainly. One crucial step is what we call “marshaling estate assets.” This involves identifying and inventorying all of the deceased person’s assets. Ordinarily, this includes everything from bank accounts and real estate to personal property like vehicles and jewelry. Consequently, it’s essential for ensuring a complete and accurate accounting of the estate.

We begin by reviewing the will (if there is one) and any other relevant documents. Moreover, we often contact financial institutions, government agencies, and other parties to obtain information about accounts and assets held in the deceased person’s name. This process can sometimes be complex, particularly if the individual owned businesses or had investments in multiple locations.

Once all assets are identified, we prepare a detailed inventory and appraisal. This document lists each asset, its estimated value, and any outstanding debts or liens associated with it. The Inventory and Appraisal is then filed with the court for approval.

Notwithstanding these complexities, marshaling estate assets is a fundamental step in ensuring that the probate process proceeds smoothly and fairly.

I recall one case where we were tasked with locating hidden assets. It turned out the deceased had stashed away a sizable collection of rare coins. Without careful investigation and communication with family members who were unaware of the collection, those valuable assets would have been overlooked.

  • According to a 2022 study by the American Bar Association, over 70% of probate cases involve the need for asset marshaling.

Steve, have you ever encountered any challenges during this stage of the process?

Steve:

Certainly. Sometimes locating and valuing assets can be difficult, especially if there are no clear records or if family members disagree about the value of certain items. Nevertheless, we always strive to approach these situations with empathy and a commitment to finding fair solutions.

I remember a case where siblings were arguing over the value of their parents’ antique furniture. We brought in an independent appraiser to assess the pieces objectively, which ultimately helped them reach a compromise.
